1 Oracle Database Express Editionライセンス契約

本ライセンスを使用するには、次のすべての条件に同意する必要があります。

輸出適格制限

お客様は、キューバ共和国、イラン・イスラム共和国、スーダン共和国、イラク共和国、リビア共和国、北朝鮮、シリア・アラブ共和国その他アメリカ合衆国が輸出を禁止している国家（以下「対象国家」といいます。）の市民、国民、居住者、又は、その統制下にある者（以下「対象者」といいます。）であってはいけません。

お客様は、直接的にも間接的にも、対象国家又は対象者に対して、本プログラムをダウンロードし、輸出もしくは再輸出してはいけません。

お客様は、アメリカ合衆国財務省のリストにおいて"Specially Designated Nationals"、"Specially Designated Terrorists"、又は、"Specially Designated Narcotic Traffickers"として指定されていてはならず、又、アメリカ合衆国商務省のリストである"the United States Department of Commerce Table of Denial Orders"に記載されていてもいけません。

お客様は、直接的にも間接的にも、上記リスト記載者に対して、本プログラムをダウンロードし、輸出もしくは再輸出してはいけません。

お客様は、アメリカ合衆国法により禁止される目的（大量破壊兵器である核兵器、化学兵器、生物兵器の開発、設計、製造を含みますがこれに限定されません）のために本プログラムを使用してはならず、使用させてもいけません。

「オラクル」とは、Oracle USA, Inc.及びその子会社・関連会社をいいます。「お客様」とは、本プログラムを入手した個人又は団体をいいます。「本プログラム」とは、お客様が入手したソフトウェア製品とプログラム・ドキュメンテーションをいいます。「本ライセンス」とは、本条件に従って本プログラムを使用するお客様の権利をいいます。本契約は、アメリカ合衆国カリフォルニア州法に準拠するものとします。本契約にかかわる紛争の一切は、カリフォルニアの裁判所を専属管轄とするものとします。

お客様が本契約に規定されているすべての条件を承諾した場合にのみ、オラクルは本プログラムの使用をお客様に許諾するものとします。本条件を熟読の上、これを承諾する場合には、ページ下部の「本条件を承諾します」というボタンを選択するか（オンライン・システムでライセンスを取得する場合）、本プログラムのインストールを続行してください（インストールのプロセスの途中で本契約を受領した場合）。本条件を承諾しない場合には、「本条件を承諾しません」というボタンを選択するか、インストールのプロセスを中断してください。この場合、お客様の登録プロセスは中断されます。

権利許諾

オラクルは、お客様に対して、（a）お客様独自の内部的なデータ処理業務のためのお客様のアプリケーションの開発、プロトタイピング及び実行を目的として、本プログラムを使用する非独占的、譲渡不能かつ限定的な使用権を許諾します。（b）お客様は、お客様のアプリケーションとともに本プログラムを頒布することができます。（c）お客様は、第三者に対しデモンストレーション及び研修を提供する目的で、本プログラムを使用することができます。（d）お客様は、お客様の各ライセンシーが本契約の条件に同意する場合、ライセンシーに対し、本プログラムを複製して頒布することができます。お客様は、本契約で認められている以外の目的で本プログラムを使用することはできません。本プログラムのドキュメンテーションは本プログラムに同梱されているか、オンラインにてアクセスできます（http://www.oracle.com/technology/documentation/）。

Oracle Database Express Editionのいかなる使用に対し、次の制限が課せられるものとします。1. Express Editionはいかなるサーバーでも単一インスタンスに制限されます。2. Express Editionは複数CPUサーバーにインストールできますが、いかなるサーバーでも実行可能なプロセッサは1つのみです。3. Express Editionは、最大11GBのユーザー・データ（Express Editionシステム・データは除く）をサポートする場合にのみ、使用することができます。4. Express Editionは使用可能なメモリーのうち最大1GBまで使用することができます。

商標権及び著作権

お客様は、"ORACLE"を含むオラクルの商標又は"ORA"を含むオラクルの商標と混同のおそれがある類のものを、お客様の製品名、サービス名、会社名、又はドメイン・ネームの一部として使用しないことに同意します。本プログラムのマーケティング、販売促進、もしくは頒布の際には、お客様は、本プログラムの提供元がオラクルであることを明確に表すことに同意します。お客様が使用又は頒布する本プログラムのすべての複製に、次のものを含めるものとします。

オラクルの著作権表示の再現
著作権がお客様に付与されていることを示す著作権表示であって、次の内容を含むもの
1. 円で囲んだ「c」及び「著作権」という語
2. お客様の名称
3. 著作権の日付
4. 「All rights reserved.」という語

ドキュメンテーション、本プログラムが組み込まれたソフトウェアのサインオン画面及び本プログラムが格納されたメディアに対し、当該表示を付するものとします。

権利及び制限

本プログラムに関わる所有権ないし知的財産権はすべてオラクルに帰属します。本プログラムの複製は、バックアップ・コピーのために合理的な部数を作製することができます。

お客様は、以下の行為をすることができません。

オラクルの財産権の表示や通知を除去又は変更すること
本契約で別途規定されている場合を除き、本契約の地位譲渡、本プログラムの権利や持分を他の個人又は団体に譲渡すること
本プログラムのリバース・エンジニアリング又は逆コンパイルを自ら行い、又は第三者にそれらの行為を許可すること
オラクルの事前承諾なく、本プログラムのベンチマークテストの結果を開示すること
本契約で別途規定されている場合を除き、オラクルの名称、商標又はロゴを使用すること

輸出

技術データを含む本プログラムの使用に対して、アメリカ合衆国の輸出管理規制法その他輸出入関連法規（以下、総称して「輸出関連法規」といいます。）が適用されます。お客様は、本プログラム及びこれより直接発生する物品を、直接的にも間接的にも輸出関連法規に違反して輸出すること、また、輸出関連法規によって禁止される目的（核兵器、化学兵器、生物兵器の拡散を含みますがこれに限定されません）のために使用することはできません。

保証、免責及び唯一の救済措置

本プログラムは現状有姿かつ保証なしで提供されるものとします。オラクルは、明示であるか黙示であるかを問わず、一切の保証責任（商品性及び特定目的への適合性についての黙示的な保証を含みますがこれに限定されません。）を負いません。

オラクルは、お客様又は第三者が被った間接損害、付随的損害、特別損害、懲罰的損害又は結果的損害について、あるいは、逸失利益、売上の喪失、データ又はデータの使用機会の喪失について、契約責任に基づくものであるか不法行為責任に基づくものであるかを問わず、又、お客様から損害発生の可能性を通知されていた場合であっても、何ら責任を負わないものとします。本契約に基づくオラクルの損害賠償責任の上限は1000米ドルとします。

テクニカル・サポート

オラクルは、本契約に基づき許諾された本プログラムについて、テクニカル・サポート、電話でのサポート、同プログラムのアップデートの提供を行いません。

契約の終了

お客様は、本プログラムの複製をすべて消去することによって、本契約を終了することができます。オラクルは、お客様が本契約に違反した場合、本プログラムの使用権を終了させることができます。この場合、お客様は本プログラムの複製をすべて消去するものとします。

当事者の関係

お客様とオラクルとの関係は、ライセンシーとライセンサーの関係であるものとします。いずれの当事者も、明示であるか黙示であるかを問わず、相手方当事者に代わってこれに義務を負わせる権限を有することを表明することはできず、又は、相手方当事者の代理人、使用人、フランチャイズ加盟店その他の資格を有する者であることを表明することはできません。本契約は、相手方当事者が権利を有する情報がソフトウェアに使用されていない限り、当事者が相手方当事者の製品と類似の機能を有するソフトウェアの開発及び頒布を独自に行う権利を制限するものではありません。

制限付権利

アメリカ合衆国政府による使用、複製又は開示には、DFARS 252.227-7013（c）（1）（ii）及びFAR 52.227-19（c）（2）のテクニカル・データ及びコンピュータ・ソフトウェアに関する条項の権利で定義されている制限が課せられます。製造業者はOracle Corporation（500 Oracle Parkway, Redwood City, California 94065, U.S.A.）となります。

オープン・ソース

オープン・ソース・ソフトウェア（以下「OSS」といいます。）とは、無償で使用、変更、頒布することができるソフトウェアであり、多くの場合ユーザーによる変更義務を負わせる条件の下にライセンスされるもの、又は、ユーザーがソースコードの形態で無償で入手可能なオープン・ソース・ソフトウェアと組み合せたソフトウェアをいいます。お客様がOSSを本プログラムとともに使用する場合、お客様は以下の義務を負うものとします。お客様による使用により、（i）オラクルが保有するプログラム（以下「オラクル・プログラム」といいます。）につき、オラクルの義務や責任をなんら発生させないこと、（ii）第三者に対して、Oracleプログラムの知的財産権その他の権利、又は、免責特権を付与しないこと。例えば、オープン・ソース・プログラムのライセンス条件が変更を無償で許諾するものである場合、お客様は、オラクルのプログラムとオープン・ソース・プログラムを使用して双方のプログラムのコードを含むプログラム・ファイル（ライブラリーがその例ですが、これに限定されるものではありません）を開発することはできません。お客様は、オラクルのプログラムとGNU General Public License（以下「GPL」といいます。）に基づくプログラムとを組み合せることにより、オラクルのプログラム及びその改変物に対してGPLの条件が適用される事態を招くこと、又はその危険を生じさせることはできません。

その他

オラクルは、45 日前までに書面で通知することにより、お客様による対象プログラムの使用状況について、監査を行うことができます。お客様は、オラクルの監査に協力し、合理的な範囲内で助力及び情報を提供することに同意します。お客様は、監査に協力することによってお客様に生じたあらゆる費用について、オラクルは責任を負わないことに同意します。

完全合意

お客様は、本契約が本プログラム及び本ライセンスに関する完全な合意であり、本契約は本契約締結時点以前になされたすべての合意や意思表示に取って代わることに同意します。本条件の一部が無効又は強制執行不能であることが判明した場合であっても、他の条項は有効に存続するものとします。
