This Agreement was specifically superseded by: Amendment Number 4 dated 8/31/2009 to the Technology License Agreement between Progress Software Corporation on behalf of its DataDirect Technologies operating company and Oracle USA, Inc. dated 10/31/2001.  See entry for that Agreement instead.
