3.2 Written Offer for Source Code
For third party technology that you receive from Oracle in binary form which is licensed under an open source license that gives you the right to receive the source code for that binary, you can obtain a copy of the applicable source code from this page. If the source code for the technology was not provided to you with the binary, you can also receive a copy of the source code on physical media by submitting a written request to:
- Oracle America, Inc.
- Attn: Associate General Counsel
- Development and Engineering Legal
- 500 Oracle Parkway, 10th Floor
- Redwood Shores, CA 94065
Or, you may send an email to Oracle using this form. Your request should include:
- The name of the component or binary file(s) for which you are requesting the source code
- The name and version number of the Oracle product
- The date you received the Oracle product
- Your name
- Your company name (if applicable)
- Your return mailing address and email
- A telephone number in the event we need to reach you.
We may charge you a fee to cover the cost of physical media and processing. Your request must be sent (i) within three (3) years of the date you received the Oracle product that included the component or binary file(s) that are the subject of your request, or (ii) in the case of code licensed under the GPL v3, for as long as Oracle offers spare parts or customer support for that product model.

Oracle | OCI SDK for TypeScript and JavaScript 2.81.0 |
Development is requesting to use OCI SDK for TypeScript and JavaScript 2.81.0 for internal, distributed, hosted by Oracle, and hosted by third party use. This software is dual-licensed under the UPL and Apache 2.0 license, where Oracle elects the UPL. It has dependencies licensed under the ISC, MIT, BSD 3-clause, Apache 2.0, WTFPL, and public domain. All relevant terms are summarized below. Terms 1. Use: Oracle may freely use, modify and distribute the Licensed Technology and Covered Dependencies. 2. Warranty: none. 3. Limitation of Liability: With respect to the Licensed Technology, Oracle has no liability to end user licensees under the UPL and would likely be liable for all damages if that Licensed Technology infringes a third party’s IP rights. With respect to any Covered Dependencies, the authors have no liability while Oracle maintains unlimited direct and indirect liability. If the Covered Dependencies infringe a third party’s IP rights, Oracle could be liable for all damages without recourse against the authors. 4. Attribution: Development must not remove any notices or license terms from the Licensed Technology or the Covered Dependencies. If this BA covers distributed use of the Licensed Technology in connection with one or more Oracle products, Development must also ensure that a complete copy of the license terms and copyright notices identified in the Attribution Requirement Note field are included in the documentation (e.g., the License Information User Manual) for each Oracle product that includes the Licensed Technology pursuant to the requirements specified in the Oracle Product Documentation Policy. 5. Marketing: Oracle may not use the name of the copyright holder(s), or the names of any contributors, to endorse or promote Oracle products using this Software without specific prior written permission. |

Eclipse Foundation | Jakarta Annotations API 3.0.0 |
Development is representing that the specific version of the third-party component covered by this 3PLTA record (the “Licensed Technology”) and any Covered Dependencies satisfy the conditions for pre-approval or contingent pre-approval of a distributed use case as documented in Oracle’s Open Source Approval Policy. Development is also representing that it has searched the Licensed Technology and any Covered Dependencies, including any readme, notice, license or text files, and confirmed that: (a) the Licensed Technology is licensed exclusively under the EPL 2.0 license; and (b) the Covered Dependencies, if any, are licensed exclusively under one or more of the licenses eligible for pre-approval or contingent pre-approval of distributed use as documented in Oracle’s Open Source Approval Policy. Development has confirmed that there are no plans to do any modifications. Should development have to, for some reason, modify the Software, they can comply with the restrictions. Terms: 1. The Eclipse Public License (EPL) is a copyleft license in that changes to, additions to, or derivative works of the originally licensed code must be provided in source code under the terms of the EPL. However, any separate software modules distributed with the EPL code are not subject to the EPL terms. 2. Oracle is granted broad rights to use, copy, modify and distribute the EPL code, subject to certain terms and conditions described below. 3. Development has confirmed that Oracle has not changed, added to or created derivative works of the EPL code. 4. Oracle may make the code available in executable form under any agreement, but Legal advises that the executable files that contain EPL code (i.e., those that are not to be Oracle proprietary) be kept separate from all other files that do not contain EPL code (e.g., not compiled together to form a single executable file). 5. Code that is provided in executable form must also be made available in source code form only under the terms of the EPL. This means that all of the bug fixes or any other changes made by Oracle must be provided in source code under the EPL license. Licensees must be informed of how they can get copies of the source code, and a copy of the EPL license must be provided with the source code. Legal recommends that a standard website be maintained by Oracle that allows for downloads of the EPL covered source code and that the site be listed in the documentation of the Oracle product that includes the EPL code. 6. There must be a notice in the modifications identifying Oracle as the author of those modifications. 7. Oracle must indemnify other contributors to the EPL code if they incur liability as a result of any warranty, support, indemnity or liability terms offered by Oracle. 8. As a result of licensing the code under the EPL license Oracle: a. warrants it believes the modifications and additions to the EPL code are original Oracle work or that it has sufficient rights to grant the licenses. This could subject Oracle to an independent suit in the event we are in error. However, the general limitation of liability appears to apply thus liability would likely be only for provable direct damages. b. grants copyright licenses to the modifications and additions including the right to include as part of a larger work. c. grants a patent license for use of the modifications and additions, alone or in combination with all or part of the version of the software Oracle distributes. Thus, so long as Oracle's modifications are included, Oracle would be precluded from suing downstream licensees for patent infringement of the code distributed by Oracle. Note that there is also a defensive suspension clause: Oracle’s license to the EPL code terminates in the event Oracle brings a patent infringement claim regarding the EPL code against any contributor to the EPL code. 9. Notices contained within the code must not be removed. 10. Generally standard disclaimer of warranties. If there is a problem with the code, including infringement, Oracle will be solely liable for damages without any recourse against the contributors (unless the contributor knew that the code infringed. However, the contributor is probably not that solvent). However, this works in Oracle's favor with respect to distribution of the source code (although not the object code to the extent it is under the standard Oracle agreements). 11. Automatic termination of the license in the event Oracle breaches and fails to cure within a reasonable period of time. 12. Survival terms limited to existing licenses validly granted by Oracle. 13. Neither Oracle (as licensee or distributor of the EPL code) nor the authors maintain any liability. However, if the EPL code infringes a third party’s IP rights, Oracle will be fully liable for all damages. Oracle will also be liable to Oracle customers under the terms of the Oracle license. |
