Phase Forward has right to bundle the Software and Related Documentation with the Phase Forward Products. Phase Forward will have right to remove Cognos Proprietary markings in bundling the Software and Related Documentation with the Phase Forward Products provided that it includes language in the bundled product that protects Cognos intellectual property rights (Agreement, Sec. 2.4 - Pg. 3)

Any use of the Marks in any medium by Phase Forward will be subject to prior review and approval of Cognos, which will not be unreasonably withheld, delayed or conditioned, and must conform to the prevailing Cognos policies relating to the use of the Marks. Cognos will respond to any Phase Forward request to use the Marks within 3 business days of receipt. (Agreement, Sec. 7.2 - Pg. 4)

Phase Forward will display a legal notice (a link is acceptable for the electronic copy) that contains the following legend: "Cognos is a trademark or registered trademark of Cognos Incorporated in the United States and/or elsewhere. [Insert your corporate name] is independent of Cognos Incorporated. Used with permission." (Copyright Letter)

Note: Mapping Sheet 1 Row 2 provides that the Software includes third party components listed in pdf 14.6.3.2.1.256 Cognos_8.2_Copyright_Notices and 14.6.3.2.1.257 Cognos_8.4_Copyright_Notices of the Agreement. The code licensed pursuant to the Academic Free License is an integral part of Cognos, so Phase Forward cannot remove the third party code licensed pursuant to the Academic Free License without impacting the functionality of the Cognos application. Under Column BD, Oracle seeks remediation estimate for this. It further confirms that “our understanding is that eventually we will remove this dependency.”
